Como citamos na msg anterior, nosso objetivo em abordar este tema foi somente esclarecer os fatos e deixar claro nossa indignação com o que ocorreu com nossos amigos que freqüentam o fórum e com os pescadores de boa fé, de um modo geral.
E claro q não iríamos lidar com um tema tão delicado, baseados apenas em reportagens de jornais.
Para expor tais fatos, entramos em contato telefônico com o Sr. Marcelo Dutra, analista ambiental do IBAMA de Manaus, o qual esteve envolvido na operação que culminou com o cancelamento do evento. Ele nos disse que as informações sobre o torneio foram levantadas em março último, através de fontes do próprio órgão. E como perceberam que o evento seria realizado em área de proteção ambiental, procuraram contato com os organizadores, fato que foi levado a efeito através do advogado dos organizadores, o qual alertaram sobre as irregularidades.
Ocorre que nem o advogado nem qualquer outro representante do evento voltou a contatar o IBAMA, de modo que os mesmos resolveram assumir por conta e risco a realização de um evento que já tinha sido declarado como ilegal.
Por fim, o IBAMA resolveu agir, e no decorrer da operação Anavilhanas, estiveram no local, onde comprovaram inúmera irregularidade, entre as quais, falta de autorização para operar na área, falta de licença ambiental, falta de empresa instituída, entre outras.
Segundo a mesma fonte, há ainda outras questões que estão sendo investigadas pela Polícia Federal e que envolve a invasão e abertura por estrangeiros de negócios ilegais em território nacional, e por conseguinte, da sonegação de impostos, evasão de divisas e outros crimes.
O Sr. Marcelo Dutra também nos disse que os empreendimentos que existem dentro do rio Unini foram embargados, e como foram construídos ou edificados em local proibido, serão demolidos.
E com o exposto acima, a adminstração TUCUNAZUL encerra sua particiapação neste episódio, já que nossa intenção é apenas informar.”

“Friends,
Thank you for your terrific support in the face of a most difficult situation. Let me address the issues that have been raised on this forum and the Brazilian forum. First, it is accurate that we were on the Unini River without the proper documentation. As mentioned in one post, IBAMA contacted my attorney about 90 days ago to instruct us on the new requirements for documentation in the newly established conservation area. My attorney failed to call attention of this contact to me, and he failed to respond to the instructions of IBAMA. As a result, when I asked if everything was in order for the opening of our season and for the tournament, he assured me that it was. With that assurance, I proceeded to open the season and atencipate the tournament. Of course, I recognize that I am ultimately responsible for the actions of my attorney, and I will deal with that as a separate issue.
Second, we met with the representatives of IBAMA and the Federal Police, and each promised their cooperation in resolving these issues quickly. There have been newpaper articles written in Manaus about the events of the Federal Police and raids made on Commercial fishermen in Nova Airon and other locations on the Rio Negro. In each article, the action against us was mentioned but not expounded upon. No one from the newspaper has tried to contact us to get our perspective of the events. Most of the coverage is focused on the commercial fishermen, and no one has made any accusation against us about failure to pay taxes or any other matter except that outlined in my first post - entering the Unini without permission and having clients on the Unini without permission. No other charges have been leveled, nor have we had an opportunity to defend ourselves against said chargers. Remember the principle that a person is considered innocent until proven guilty, and a charge is not the same as a conviction.
Third, the Unini River was designated as a Resex area (conservation area) with the help of the operators and the people in the villages along the Unini River. At the time, we were all assured that the control of the river would be placed in the hands of the locals - not IBAMA. We believed that the Unini River was a unique place that should be protected from additional invasions and from commercial fishing. That support has now turned to bite us in the ass. IBAMA has usurped the control from the villages and has determined to rid the river of all structures including the homes of the villagers - forcing them to move to a central community far from the places they have called home. IBAMA has made no secret about wanting to eliminate all structures from the river - however, they must make compensation before this can be done. To date, we have received no offer of compensation, and our investment in the facilities is significant. In the meantime, IBAMA has no authority to destroy buildings at our camp or in the villages.
Fourth, when the Unini River was designated as a conservation area, we were assured that the agreements which we had negotiated with the local villages in 2004 and to last until 2009 would remain in effect. This agreement had been signed by the association of the villages of the Unini, by Amazon Fishing Adventures and by the companies of River Plate Anglers and approved by IBAMA. It was represented that a committee consisting of representation from the villages, the sport fishermen and IBAMA would meet to develop the rules and regulations for the area and to create a master plan for preserving the area. At no time was this committee formed. We were told within the past week, that we would not be able to get those rules and regulations and the conservaion plan until after the first of next year - so the reason we were denied a license was not a valid reason.
Next, the Unini River was set aside by Federal Decree as a pilot river to try a new method of regulating the rivers of the Amazon. Two operators were given permission to fish the area and to conduct a study of the impacts of sport fishing and commercial fishing within the area. As a result to validate the study, other operators were not permitted in the river. The study is now concluded and it is up to IBAMA to determine who will be permitted in the future on the river without doing damage to the environment.
Finally, I will tell you that we are working diligently with the authorities and our new attorneys to find a full and satisfactory resolution to these problems. I will report to you on the progress that is being made after we receive final decisions from the authorities. In the meantime, any speculation about the outcome is just that - speculation. I ask that you reserve final judgement about our operations until you receive the final disposition of this case.
I will try to continue to be responsive to issues raised on the forum. I remain in Manaus working to find a solution that will allow us to reopen our camp in the next few days and to have a complete season.

“My friends,
It is with regret that I must report that the tournament scheduled for last week has been postponed to the week of November 29 - December 7, 2007. The current tournament was delayed because of the actions of IBAMA and the Federal Police who invaded our camp the afternoon before the tournament was to begin because of a complaint filed against our operations.
We were cited for entering the Unini River (within a newly established conservation area) without permission and for operating a sport fishing business within the same area without the proper licenses. In our opinion, the first charge was not valid because we had obtained verbal approval to enter the river from an IBAMA representative and the inspection stationed of IBAMA at the mouth of the Unini River allowed us to pass without incident.
The second charge proved correct in that the approval we had obtained 3 years ago which was to be valid for a period of five years was invalidated by the establishment of a conservation easement, and we did not have the latest license - the terms and conditions of which have not yet been established.
A third accusation was that our airstrip was illegal which proved false. The airstrip had been inspected recently and the permit renewed for an additional eight years.
I have maintained a Brazilian attorney in Manaus on a retainer basis with one instruction´: Keep our operations legal in all respects. As late as one week before the tournament, I inquired of him if all permits were in order to assure no interference with the opening of our season or of the tournament. He assured me that all was in order. With that assurance, we proceeded.
The reality was that he misrepresented to me the status of our permits and that he had been instructed about the procedures necessary to secure the permit, and he failed to follow up on them. At the time of the invasion, we made numerous attempts to contact him without success. Even his office claimed that they did not know how to contact him, other than to say he was out of the country.
I take full responsibility for the delay in the tournament, but I was acting in good faith based on the instructions of my attorney. As you might expect, the day after the invasion, I had a new attorney, and I am monitoring on a daily basis their actions to assure full compliace with all laws and permits. The representatives of IBAMA and the Federal Police have offered their support in helping us to resolve these difficulties.
It is unfortunate that someone made the accustion and arranged for the invasion just before the tournament was to begin. He not only hurt me as an operator of sport fishing, but he hurt all of the Brazilians, Americans, Venezuelans and Brits who had spent much time and money to participate in this world event. I trust that this person is finding great satisfaction in embarrasing us in front of the world. We will correct the deficiencies at once, and we will have a great tournament - though delayed.

é com pesar que devo relatar que o torneio programado para a última semana foi postergado até a semana entre os dias 29 de novembro a 7 de dezembro de 2007. O torneio foi adiado por causa das ações do IBAMA e da Polícia Federal que invadiram nosso acampamento na tarde anterior ao início do torneio por causa de uma denúncia apresentada contra nossas operações.
Fomos autuados por entrar no rio de Unini (dentro de uma área de conservação recentemente estabelecida) sem permissão e por operar uma empresa de pesca esportiva dentro da mesma área sem as autorizações necessárias. Em nossa opinião, a primeira acusação era inválida, pois havíamos obtido a aprovação verbal de um representante do IBAMA para entrar no rio e o posto de inspeção do IBAMA instalado na boca do rio Unini permitiu que passássemos sem incidentes.
A segunda acusação se provou correta já que a licença que obtivemos há 3 anos, e que deveria ser válida por um período de cinco anos, foi anulada pela criação de uma área de conservação, e não tínhamos a nova licença – para a qual os termos e condições ainda não foram estabelecidos.
A terceira acusação era que nossa pista de pouso era ilegal, o que se provou falso. A pista havia sido inspecionada recentemente e a licença renovada por oito anos adicionais.
Contratei um advogado brasileiro em Manaus, o pagando mensalmente com uma única ordem: Mantenha nossas operações legais em todos os respeitos. Uma semana antes do torneio, questionei se todas as licenças estavam em ordem a fim de evitar qualquer interferência na abertura de nossa temporada ou do torneio. Ele me assegurou que tudo estava em ordem. Com essa garantia, prosseguimos.
A realidade era que ele distorceu para mim a condição real de nossas licenças e que apesar de ter sido instruído sobre os procedimentos necessários para conseguir a autorização, não deu continuidade aos mesmos. No momento da invasão, fizemos inúmeras tentativas de contatá-lo, sem sucesso. Mesmo no seu escritório disseram que não sabiam como contatá-lo, apenas disseram que ele se encontrava fora do país.
Assumo toda responsabilidade pelo atraso do torneio, mas estava agindo de boa fé baseado nas instruções de meu advogado. Como é de se esperar, contratei um novo advogado no dia seguinte à invasão, e estou monitorando diariamente suas ações para assegurar a conformidade absoluta com todas as leis e licenças. Os representantes do IBAMA e da Polícia Federal ofereceram seu apoio para ajudar-nos a resolver estas dificuldades.
É triste que alguém tenha feito essas acusações, elaborando para que a invasão fosse logo antes do torneio começar. Feriu-me não somente como um operador da pesca esportiva, mas feriu todos brasileiros, americanos, venezuelanos e ingleses que gastaram muito tempo e dinheiro para participar neste evento mundial. Acredito que esta pessoa está sentindo uma grande satisfação em nos humilhar perante o mundo. Corrigiremos as deficiências prontamente e teremos um grande torneio – só que atrasado.

Nosso amigo Steve Townson deixou este recado para todos nós. Ele é uma grande pessoa e um excelente pescador, tanto que venceu o primeiro torneio… Steve, foi um prazer poder conhece-lo pessoalmente. Espero um dia poder pescar ao seu lado.

Foi com grande prazer que finalmente consegui a conhecer voçés todos quando encontrámos no Hotel Taj Mahal. Infilizmente, já voltei hoje a Portugal com coração bem pesado e cabeça bem stressada. Viajei tanto para juntar com voçés e o resto de meu team, e para participar no evento do ano. Um ano em planear, sem pensar no dinheiro e tempo perdido!
Se Deus quizer, podemos reiniciar o nosso sonho no fim de Novembro/Dezembro como está previsto.

Na pescaria não existe barreiras, em pouco tempo fizemos grandes amigos. Os americanos fizeram questão de vir até o aeroporto para se despedir e confirmar que estaríamos novamente aqui na nova data.

Então pessoal, quem lê este título não entende ou fica assustado. Mas infelizmente é verdade. Vou tentar explicar aqui o que aconteceu.
Chegamos aqui em Manaus e viemos para o hotel. Até então tudo estava correto e a previsão de saida era para o próximo dia as 5 da manhã. Durante a tarde recebemos a notícia de que tinhamos um problema que já estava sendo resolvido e sairiamos na hora do almoço. A hora do almoço passou e não saimos. Depois chegou uma outra notícia. O IBAMA junto com a Polícia Federal haviam descido com um avião e um barco lá no local do evento. Todas as pessoas que estavam lá retornaram e o local foi fechado. Então o Don Cutter, que é o dono teria vindo para Manaus tentar resolver. Até este momento não tinhamos mais informação do que isto.
O dia passou e praticamente nenhuma informação. Mais tarde ficamos sabendo que estavam entrando com uma liminar no fórum para que o torneio fosse realizado e que no mais tardar no outro dia pela manhã teríamos um retorno.
Acordamos cedo e seguimos para o café da manhã. Toca o telefone do Hidelbrando. Era a advogada do Don Cutter pedindo para que algumas pessoas fossem até o fórum levando o cartaz do torneio para confirmar que realmente iria acontecer.
Sairam Luizão, Hidelbrando e Willer… foram até a casa da juiza e apresentaram tudo. Inicialmente ela pareceu entender e até tentou ajudar. Mas a juiza de plantão era outra, e esta é quem poderia deferir ou não. Isto foi logo cedo..
A resposta ficou marcada para o horário do almoço. Um pouco depois do almoço os americanos vieram para o hotel e tudo parecia muito bem… belas risadas… boas conversas…
Depois adiada para as 14 horas… e depois adiada para as 17 horas. Quando chegou a hora final recebemos a informação - O TORNEIO ESTAVA PROIBIDO PELO JUIZ FEDERAL. Claro que nem precisa dizer como foi a nossa cara… chegar até Manaus para pescar em um local maravilho e nem sequer colocar uma isca na água.
Então tínhamos 2 opções.
1. Tentar levantar dois barcos e subir para o Sucundurí
Encontramos os barcos, mas precisavamos voar ate Nova Olinda, esperar abastescer e carregar todos os suprimentos do barco e depois subir o rio por 12 horas para chegar nos pontos de pesca.
2. Ou voltar para casa.
Nesta opção todo o nosso gasto seriam devolvido e voltaríamos a hora que fosse melhor.
Ficamos num dilema… tentava arrumar uma pescaria ou voltávamos para casa… arrumamos várias pescarias, porém todas elas caras, pela urgência da coisa e com horas de viagem ou com fretamento de avião. Ou seja, praticamente inviável.
A escolha da maioria foi retornar. Nesta hora que a gente separa as pessoas sérias das outras.
O Don chegou para TODOS e disse que ele iria restituir todo o dinheiro e todo e qualquer custo que tivemos em nossa estadia. Pagando a passagem de todos, mais os custos envolvidos com remarcação e as diárias e alimentação. Depois disso colocou dois advogados para que pegassem todos os dados da turma, remarcassem os voos e calculassem o que cada um gastou. Escreveram um contrato entre a empresa e a pessoa onde eles garantem tudo o que foi falado. Contrato assinado entre todas as partes. Dentro de 30 dias todo o dinheiro seria devolvido - prazo estipulado pelo Código do Consumidor.
Eu nunca tratei com pessoas tão transparentes e corretas assim… coisa dificil de se ver.
Então foi assim… todos terão seus custos pagos e o dinheiro devolvido… e além disso ficou o convite para retornar em uma hora oportuna e um desconto especial a cada um deste grupo.
Mas vocês devem estar pensando… PORQUE O AVIAO FOI PARAR LÁ? QUEM DENUNCIOU…
Bom, estou é outro caso… um caso de muita inveja e de vingança… Um operador de turismo de pesca da região fez a denuncia de que o Don não tinha liberação para organizar um torneio. Esta pessoa tinha todas as informações possívels, incluindo horários de voos.
Eu sei o nome de quem fez, mas ainda não recebi a comprovação nem mesmo os documentos. Mas a advogada do Don vai me enviar todos. Assim todos vão ter acesso a estes documentos.
Não sei se vcs podem, mas tentem imaginar a nossa situação… quase 1 ano programando o torneio… comprando material… preparando … preparando….
Eu estou voltando pra BH amanha as 3:15 pm. Chegando a BH tarde da noite…
No momento que eu tiver a documentação eu apresento quem fez a denúncia e todas as provas…
Infelizmente isto tudo é verdade, adoraria estar fazendo uma brincadeira… mas não é.

TOURNAMENT CANCELED
Well friends; one who reads this title might worry or not understand. But unfortunately it is real. I’ll try to explain what happened.
We arrived here in Manaus and went to the hotel. Up until then everything was going according to plan and we were scheduled to start the next morning at 5 AM.
In the afternoon we received some news that there was a problem that was being taken care of, and that the start had been postponed for lunch time. Lunch time came and gone and still we had not left to start. Later on we got some more news. As a joint taskforce, IBAMA (the Brazilian Ministry of the Environment’s enforcement agency) and Brazilian Federal Police had arrived at the place of the event with a boat and a plane. Everyone who was already there had been returned and the place was deemed off-limits. Don Cutter, the events owner, headed back to Manaus to try to settle the matter. This is all we knew up until that moment.
The whole day went by without us having any further information. Much later on we heard that a court order request was being filed to guarantee that the tournament could go on and that we would be informed the next morning, the latest.
We got up early and went on to have breakfast. Hidelbrando’s phone rings. It was Don Cutter’s lawyer asking for some people to go to the court house with the tournaments posters, to prove what was really about to happen there.
Luizão, Hidelbrando and Willer left… they went straight to the judge’s home and presented the printed material.
The ruling was scheduled for lunch time. The Americans arrived at the hotel a little after lunch and everything appeared to be fine… nice laughs… good chats…
Later on the ruling was delayed to 2 PM… and then further delayed to 5 PM. As the final hour approached we were informed that THE TOURNEMNT WAS BARRED BY FEDERAL COURT. Needless to say what the look on our faces was like… to go all the way to Manaus to fish in a wonderful place, but not having the chance to get one lure in the water.
We were left with two choices.
1. Try to raise two boats and to go all the way up to Sucundurí
We would have to fly to Nova Olinda to get to the boats, wait for re-fuelling and loading of boat’s supplies and travel up river for 12 hours.
2. Or to head back home
In this case all our expense would be refunded and would come back the at a better time.
We are in a sticky situation… to try to re-arrange a fishing trip or to go back home… because of our rush, all the other fishing options were too expensive and would mean many hours flying or having to rent a private plane. In other words not really viable.
Most decided just to return home. This is the time were we can single out the “serious ones” from the group.
Don spoke to ALL and said that he would reimburse all and any costs incurred during our stay. He pledged to refund the airline’s tickets and eventual re-scheduling extras, accommodations and food expenses. Two lawyers were later arranged to gather the group’s information, re-schedule flights and to sum up each one’s total expenses. They later wrote down an agreement contract between the organizing company and each participant, guaranteeing all that was promised verbally. The contract was signed by all involved. The money is to be refunded within 30 days – as it’s established by Brazilian consumer laws.
I have never done business with such blatant and correct people… that’s something you don’t see every day.
So that was it… we all would have our costs reimbursed and the money returned…. Besides that, we were invited to come back at a better time with a special discount for everyone in the group.
But you must be wondering… WHY DID THIS PLANE LAND THERE? WHO CALLED THE AUTHORITIES?
Well that’s another issue… a matter of envy and revenge… A local fishing tour operator accused Don of not having the licenses to organize a tournament. This person had all the inside information, including flight times.
I know who did it, but still I have not received the final evidence or the official documents. But Don’s attorney will send it all to me. Thus everyone will have access to the evidence.
I’m not sure if you can, but try to imagine our situation… almost 1 year planning the tournament… buying the equipment… preparing… arranging…
I’m going back to BH tomorrow at 3:15 PM. Arriving home late at night…
I’ll present the proof and who made the accusations as soon as I get the documents.
This is all an unfortunate truth, I would love it to be a joke… but it isn’t.

Problemas… infelizmente eles existem.
Tivemos alguns imprevistos que adiaram a nossa viagem para a região do torneio. Ainda não temos informações completas sobre o ocorrido. Fato é que estamos aguardando o julgamento de uma liminar para que possamos voar e realizar o torneio. Hoje era dia de pescaria livre e ainda estamos em Manaus. Mas tudo está caminhando para que tenhamos liberação. Eu publico alguma coisa hoje mais tarde.

Notícias da Amazônia
Hoje estivemos conversando com dois americanos que chegaram da pescaria no Unini, exatamente no mesmo local onde vai rolar o torneio. Todos os dois relataram excelentes capturas e mostraram as fotos de grandes peixes. Relatos de 3 estouros de linhas de 80 lbs e várias garatéias 4x abertas. Em conversa com um deles, o Petter, ele me apresentou as 3 iscas que mais deram resultados, uma meia-água da Yo-Zury, uma outra da Alie Magnetic e uma Wood Chopper Peacoock bass. Os peixes estão estourando na superfície e atacando sempre quando as iscas passam pelos drop-offs.
Uma outra notícia boa foi que a cada dia que passou da pescaria a quantidade e a qualidade dos peixes melhorou, pois o rio está baixando 4 polegadas por dia.
Estamos embarcando amanhã as 9 para o local devido a alguns problemas que já estão sendo resolvidos. A partir disso as atualizacoes serão feitas através de telefone.

Ainda estamos em Manaus, aguardando instruções do avião que nos levará até o Unini. Mas isso foi bom, pois todos pudemos nos deitar e dormir até mais tarde e chegar lá inteiro. A ansiedade é grande entre todos e a animação também.
Hoje falei com o Renato, que vai ficar responsável por traduzir as matérias para o inglês e postar aqui. Então teremos tudo em duas linguas.
